  12. Promoting franchise schemes, pyramid schemes, or business opportunities requiring upfront payments.
  13. Sending unsolicited promotions or advertising.
  14. Posting multiple job requirements in one description.
  15. Posting jobs or content seeking money or periodic payments.
  16. Offering services such as immigration or visa processing instead of actual jobs.
  17. Deleting or altering material posted by others.
  18. Overloading HQHIRE’s infrastructure.
  19. Using data mining or similar methods.
  20. Attempting to decipher or reverse engineer our software.
  21. Copying or duplicating HQHIRE.com content without permission.
  22. Framing or linking to HQHIRE.com content without authorization.
  23. Engaging in unlawful or illegal activities, posting offensive or harmful content, or linking to explicit material.

Violation of Terms and Liquidated Damages

Our failure to immediately act on a breach doesn’t waive our right to take action in the future.

To address potential damages that may be difficult to quantify, you agree to pay HQHIRE.com the following as reasonable estimates of damages for specific T&C breaches:

  • Impersonation or Misrepresentation: Posting a message that impersonates, misrepresents affiliation, or shares personal information about someone without consent may result in a $500 fee per message. Case-by-case basis, the event maybe reported to the respective authorities when required.
  • Unsolicited Email Ads: Sending unsolicited email ads through HQHIRE.com may result in a $25 fee per email.
  • Content Violations: Posting content that violates the T&C (other than as described above) may incur a $100 fee per item of content. HQHIRE.com may issue warnings at its discretion.
  • Posting Agent Violations: Posting Agents using the service in violation of the T&C may face a $100 fee per item of content posted in violation. The Principal engaging the Posting Agent may also be liable for $100 per item of content posted by the Posting Agent.
  • Exploiting Content: Unauthorized exploitation of content (excluding your own) may result in a $3,000 fee for each day of such conduct.

HQHIRE.com retains the right to seek remedies such as specific performance, injunctions, or damages for T&C violations, as allowed by law.

Governing Law and Dispute Resolution

This agreement is governed by the laws of Singapore, for all matters including validity, construction, and performance. The courts located in Singapore have exclusive jurisdiction over any disputes. Payment

Users will be charged as indicated by the Site. Advertising charges may be based on clicks, RSVPs, applications, impressions, time period, packages or subscription/platform fees. HQHIRE’s measurements, such as click count, are binding for determining charges. Subscriptions automatically renew until canceled, with no refunds or credits for partially used billing cycles. Invoices may be provided via email, and unpaid balances can lead to account suspension. Users are responsible for taxes and late payment penalties. HQHIRE may share payment information with third parties for processing and legal purposes.

Advertising Charges

When you purchase advertising services on our platform, charges may be determined based on various metrics, including clicks, RSVPs, applies, impressions, or through subscription or platform fees. It’s important to note that all charges are calculated according to our measurements, such as click count. These measurements may utilize data from third-party vendors, like publishers, to ensure accuracy.

Subscriptions and Renewals

For subscription plans, you can find detailed information on our website at the time of purchase. When you opt for a subscription plan, please understand that it will automatically renew. HQHIRE.com will charge you on a recurring basis until you decide to cancel your subscription. Keep in mind that pausing your subscription does not cancel it. Refunds or credits for partially used billing cycles under the subscription plan are not available. Any potential refunds for prepaid unused billing cycles are determined at HQHIRE.com’s discretion.

Billing Policies

HQHIRE.com reserves the right to suspend or terminate your access to our products and services if you have unpaid or outstanding invoices. Change of Address

If you change your billing address, your existing agreement with HQHIRE.com remains in effect for the current calendar month. Starting from the first day of the next calendar month, your agreement will be bound by the applicable HQHIRE.com entity based on your new territory.

Currency and Taxes

The currency in which you’ll be charged depends on your location. For example, if you’re in the United States, you’ll be billed in US dollars. Ensure that you’re aware of your currency and its implications for your payments.

Please note that charges are exclusive of taxes and VAT. It’s your responsibility to pay all applicable taxes and government charges. If you’re in Japan, Japanese consumption tax applies to all HQHIRE.com products and services.

Refunds and Late Payments

HQHIRE.com does not offer refunds for our services. All refund decisions are at HQHIRE.com’s sole discretion. Late payments may incur penalties and statutory indemnities as per relevant laws.

Other Services

This section covers various aspects of HQHIRE’s services, including mobile apps, Apple-specific terms, e-signatures, beta programs, and algorithmic content:

  • HQHIRE Apps: The agreement applies to HQHIRE’s downloadable applications, and location data may be collected if users permit.
  • Apple-Specific Terms: Users of HQHIRE’s iOS app agree to Apple-specific terms, and Apple is not responsible for the app.
  • E-Signature: Users can use e-signatures on the site, but it’s at their own risk.
  • Beta Program: HQHIRE may offer beta products or features, which are provided as-is for testing purposes.

Terms of Service for Job Seekers or Candidates

For purposes of this Terms of Service, all references to “you” or “your” shall mean you, the individual or organization accessing this Site in your capacity as a Job Seeker or Candidate. As a Job Seeker, you are permitted to use HQHIRE’s Site and its content solely for non-commercial purposes.

Liability Disclaimer

HQHIRE disclaims liability for various aspects of its services and doesn’t act as an employment agency. Job Seekers’ rights under employment and discrimination laws apply directly to Employers.

1. Job Ads and Listings

As a Job Seeker, you can use HQHIRE’s Site for non-commercial purposes. HQHIRE provides Job Ads and Listings for free, displaying them based on relevance and compensation paid by employers. Please note that Job Ads are created by third parties, and HQHIRE does not control their content or conditions. When applying for jobs on external websites, HQHIRE may collect certain information, and employers using tracker functionality must comply with applicable laws.

2. Resume and Profile

You may have the option to create searchable resumes on HQHIRE, which can be set as “Searchable” or “Not Searchable.” HQHIRE may offer feedback on your resumes and may share job ads that match your resume. Additionally, HQHIRE may reformat resumes for better mobile viewing and provide functionality to call employers directly from job ads.

3. Applying to Jobs Through HQHIRE 

When applying to jobs through HQHIRE, your applications are subject to this agreement and HQHIRE’s Privacy Policy. HQHIRE may impose limits on your ability to apply to job listings. It’s your responsibility to confirm that you’re applying to your desired employer. Employers may use automated features to send messages about your application status.

4. Job Matching and Recommended Jobs

HQHIRE provides job matches and recommendations based on user data. These recommendations may be sent to you via the email address associated with your HQHIRE account. Please note that job matching is provided on a beta basis and is subject to a Beta Program.

5. Communications and Actions on the Site

By using the site, you agree to allow your communications and materials, such as job listings, resumes, and messages, to be processed and analyzed for various purposes, including data analysis, enforcing site rules, and improving the site. Employers may be informed about your actions on the site, and you may receive messages regarding your activity. HQHIRE may also offer text message reminders for interviews. You are responsible for ensuring your phone number is accurate.

6. Virtual Communications

HQHIRE may provide virtual communication options like phone and video interviews, but it’s not a telecommunications service provider. Technical issues may occur, and HQHIRE doesn’t guarantee the validity of contact information. Employers are responsible for interview scheduling and decisions.

7. Screening Tools

Employers may use screening tools in the application process, and the questions asked are determined solely by the Employer. HQHIRE doesn’t act as an employment agency, but it facilitates information exchange. Employers are responsible for complying with disability laws if needed.

8. HQHIRE Assessments

HQHIRE Assessments allows Employers to send assessments to Job Seekers. Completing an assessment doesn’t guarantee a job. Employers select the assessments, and HQHIRE doesn’t control their choices. Responses should be kept confidential. HQHIRE doesn’t screen assessments or responses and may exclude them from the site. HQHIRE may provide aggregate response statistics.

9. Career Services

HQHIRE offers various Career Services, including resume review, coaching, and general career guidance. When you use these services, you agree to use them for your own career needs and not for others. 11. Your Job Seeker Data

HQHIRE collects data about your job searches and activities on the site. This data is used to improve services and may be shared with employers. You can provide demographic information, but it’s optional. HQHIRE may also share data in compliance with legal obligations.

12. HQHIRE Hiring Platform

The HQHIRE Hiring Platform streamlines employer hiring processes, but employers are responsible for compliance with employment laws. HQHIRE is not an employment agency.

13. Governing Law and Dispute Resolution

The terms are governed by the laws of Singapore. Disputes shall be filed in courts in Singapore.

14. Class Action Waiver

By using the site, you agree not to participate in class-action lawsuits against HQHIRE.

15. Indemnification

You agree to indemnify and protect HQHIRE, its agents, affiliates, and licensors from any claims, liabilities, or legal fees arising from various situations, including your violation of the Agreement, your use of the Site or any HQHIRE product, disclosure of information obtained through the platform, violation of laws or regulations, infringement of third-party rights, damage caused by your content, and actions taken as a Job Seeker. This obligation continues even after you stop using HQHIRE services.

Terms of Service for Employers

For purposes of this Terms of Service, all references to “you” or “your” shall mean you, the individual or Organization accessing this Site in your capacity as an Employer or Posting Agent, or other user as described above.

Liability Disclaimer

HQHIRE disclaims liability for various aspects of its services and doesn’t act as an employment agency. Job Seekers’ rights under employment and discrimination laws apply directly to Employers.

1. Employer Accounts

When creating an HQHIRE account for posting job listings and related content on the Site, you agree to be bound by various HQHIRE policies, including the Data Processing Agreement, HQHIRE’s Privacy Policy, and Cookie Policy. If verification of your identity is required, it may involve third-party services like ID.me, with whom you share your identification information. Any data handling responsibilities arising from this verification process rest solely with ID.me.

If you are acting as an employee or representative of an Employer, you must have the authority to bind the Employer to this Agreement when creating an account on their behalf. Information provided through this account will be visible to the Employer. Your HQHIRE account should be for business use, not personal use, and HQHIRE is not liable for improper use of your email by third parties.

You may have multiple users linked to the same account (Linked Account), with varying levels of access. By adding users to a Role, you confirm your authorization and accept responsibility for data sharing and access. You can also unlink your account at any time. Employers with a credit card on file may be charged for additional products or services.

HQHIRE may send notices to Job Seekers if an Employer account is compromised, but it does not guarantee such notices. HQHIRE provides recommendations to users but does not guarantee outcomes, and you are responsible for your decisions regarding job postings, compliance with laws, and candidate selection.

2. Employer Services Including HQHIRE Apply and Screener Questions

HQHIRE offers services like HQHIRE Apply relay and chatbots to facilitate Job Seeker applications. You are responsible for your content and compliance with applicable laws. You agree to promptly update Job Listings or notify HQHIRE if changes occur.

You are responsible for complying with nondiscrimination laws, offering accommodations, and indicating the availability of reasonable accommodations. HQHIRE may reject or remove Job Listings or questions that discriminate against Job Seekers.

HQHIRE may use labels or badges on Employer names or Job Ads based on provided data. These labels may change or be removed at HQHIRE’s discretion.

If you use HQHIRE’s API or a third-party developer to integrate with an ATS, you agree to be bound by relevant terms and laws. You are fully liable for the actions of third-party developers and ATSs you use.

HQHIRE may use data analysis to improve its products, and you consent to this use of your data. Email verification and compliance with record-keeping requirements are your responsibilities.

3. Job Match

Job matches are recommendations presented to Employers and Job Seekers based on data collected through the Site. This service is subject to the Beta Program.

To generate matches, HQHIRE uses data from Job Ads, Resumes, application materials, user activity, and more. By using the Site, you consent to HQHIRE using this information to present potential matches.

4. Salary, Applies or Other Information Provided by HQHIRE

HQHIRE provides various information to users for informational purposes only. This includes estimated salaries, the number of job applications, and responses to screener questions. It’s essential to note that these figures are estimates and may come from third-party sources, so they are subject to change and may not always be accurate. Employers using the HQHIRE Ads Program will be charged based on HQHIRE’s determination of Apply count, not the informational applications provided to job seekers. Labels or badges on job ads are also for informational purposes and aren’t guaranteed to be accurate.

5. Screening Tools

HQHIRE offers screening tools for employers to use in their hiring process. Employers are responsible for using these tools in compliance with applicable laws, including employment and discrimination laws. Employers should use assessments in combination with other selection and hiring processes to evaluate relevant skills and abilities. Employers must also provide reasonable accommodations for job seekers with disabilities if required by law.

6. Communication Through HQHIRE

Employers may receive messages, emails, or notifications related to their activities on the site. These messages are provided as a courtesy, and employers should not rely solely on them. HQHIRE may mask or hide contact information, such as phone numbers and email addresses, to protect user privacy. Employers are responsible for any direct communication with job seekers. Additionally, employers should not use HQHIRE’s messaging services for sending bulk messages.

7. Virtual Communications

HQHIRE offers virtual communication options for job interviews and interactions. Employers are responsible for offering alternative methods of communication for individuals with disabilities if required by the law. Employers should also be aware that there is no protection for information shared during virtual interviews, and HQHIRE disclaims liability for the misuse of such data. Employers can choose to record virtual interviews with the consent of job seekers but must comply with all applicable laws regarding consent and data protection.

8. Virtual Evaluations

Employers can use recordings and information obtained through virtual evaluations for internal hiring purposes but should not use them for illegal, discriminatory, or fraudulent purposes. Employers are solely responsible for their use of virtual evaluations, including selecting candidates, contacting them after evaluations, and making employment-related decisions. HQHIRE does not act as an employment agency through virtual evaluations. Employers should ensure that those they share the virtual evaluations with have permission to view them.

8. Company Pages and Enhanced Profiles

When you post a job on HQHIRE, a Company Page may be automatically generated for your company. You can edit and add information to these pages. Company Pages may display publicly available information about your company and include User Content posted by individuals not affiliated with your company. You’re responsible for the content on these pages, including photos and videos you provide. HQHIRE may offer subscription-based features. These features may include analytics and insights. You can cancel your subscription at any time, and annual subscriptions do not auto-renew unless specified. Featured Employer status may be awarded at HQHIRE’s discretion based on your activity on the platform.

9. HQHIRE Academy

If you or someone from your company is part of HQHIRE Academy, you can use Graduate logos for individual use only, not for commercial purposes. You can’t represent what you’re recruiting for HQHIRE. This doesn’t create an employment relationship with HQHIRE.

10. HR Management Tools

HQHIRE may provide HR Management Tools for employers and their employees. If you’re an employee using these tools, your use is subject to this Agreement, and you’re responsible for compliance with applicable laws. HQHIRE does not provide legal advice, and your employer is responsible for legal compliance.

11. Governing Law and Dispute Resolution

The Agreement is governed by the laws of your country (Brazil, India, United States, Asia-Pacific Region, Japan, UK, France, Italy, Canada, Germany, or Ireland) based on your location. Any disputes related to the Agreement will be resolved in the courts of the relevant jurisdiction. You agree not to seek pre-suit discovery from HQHIRE and waive your right to a jury trial if you are in Singapore.

12. Class Action Waiver

By using the Site, you agree not to participate in class-action lawsuits against HQHIRE.

13. Indemnification

You agree to indemnify and protect HQHIRE, its agents, affiliates, and licensors from any claims, liabilities, or legal fees arising from various situations, including your violation of the Agreement, your use of the Site or any HQHIRE product, disclosure of information obtained through the platform, violation of laws or regulations, infringement of third-party rights, damage caused by your content, and actions taken as an employer. This obligation continues even after you stop using HQHIRE services.

14. Campaign Tools

HQHIRE offers Tools to coordinate job ads for businesses with multiple locations. Using these tools may involve sharing account information with the respective parties. Information shared includes details about your business locations, job ads, contact info, and spending. By using these tools, you agree to share this information and confirm its accuracy. You can request access for additional users, but HQHIRE will contact them based on the information you provide.

15. Candidate Import

HQHIRE provides a platform for you or authorized representatives to upload job applicant information and interact with them through “Candidate Import.” You’re responsible for obtaining necessary rights and permissions from job applicants to share their data with HQHIRE.

Entire Agreement

By accessing HQHIRE (hqhire.com), you agreed to the terms and conditions stated. These Terms constitute the entire agreement between HQHIRE (hqhire.com) and you in relation to your use of this Website and supersede all prior agreements and understandings.
